Need help getting someone out of jail?

Other holds and probation matters

Separate a new Fulton charge from a probation order, another county warrant or an immigration matter.

THE QUICK ANSWER

Meeting the bond requirement on one charge may leave a separate custody order unresolved. Ask the jail to identify each hold and the court or agency that controls it. Paying a private company does not itself cancel probation, another county warrant or an immigration matter.

Identify every remaining order

Before paying, ask the holding facility for the booking number, every charge, case or warrant number, bond status and name of each agency requesting continued custody. Ask whether the next step is a court decision, missing document or transfer. Have counsel compare that answer with the written orders. Public records and a payment receipt alone cannot establish that all release requirements have been satisfied.

A probation case is separate from the new charge

Identify the court that imposed the probation sentence and the assigned supervising officer. A new criminal bond does not resolve the alleged probation violation. Fulton Public Defender has a probation revocation division; ask the adult office at 404-612-5200 about representation. For Fulton State Court misdemeanor probation, the court FAQ identifies Judicial Corrections Services at 404-591-3180. Use the actual probation paperwork if it names a different agency or city court.

Nonpayment and failure to report are different

Tell counsel whether the allegation is inability to pay, missed reporting, a new offense or violation of a special condition. Georgia’s misdemeanor probation guidance says that when failure to pay fines, surcharges or supervision fees is the sole basis, the court schedules a hearing rather than issuing a prehearing arrest warrant. Missing that hearing can lead to a warrant. Ability to pay and alternatives matter. For a sole failure to report allegation, the guidance describes two missed reports, two contact attempts, a local jail check and a mailed ten day warning before the officer requests a prehearing arrest warrant. Special conditions have different notice and penalty rules. Keep reporting as ordered even when unable to pay. Ask counsel to review the actual order and financial evidence; do not assume every probation hold falls within this misdemeanor rule.

Another county may control the next step

Ask for the other county, issuing court, warrant number, whether a release amount exists there and whether a transfer is planned. Confirm with that jurisdiction and counsel what it will accept and where the person is expected to go. Fulton payment does not prove the second county has accepted a bond. Ask the holding jail and receiving authority to confirm current arrangements and any expected transfer time; a generic deadline cannot establish this person’s status.

An immigration matter uses a separate process

Ask whether the record refers to an ICE detainer, transfer or actual federal immigration custody. ICE’s Online Detainee Locator is a separate tool; it does not search children under 18, and a missing result is not clearance of a hold. ICE lists 1-888-351-4024 for detention inquiries. A Fulton criminal bond does not decide federal custody or immigration bond eligibility. Obtain immigration counsel for the specific document, deadlines and detention authority.

Questions about a bail bond or a hold?

Ask about the bail bond requirements. Posting a bail bond does not remove a separate hold or court order.
