Check the actual release restrictions

DUI is included in Georgia’s bail restricted offenses, limiting unsecured judicial release even for a first charge. That is not a universal denial of bail and does not mean everyone must hire a bondsman. Ask counsel and the jail which current release restrictions and order apply, what checks remain and when the permitted bond can be accepted. Do not assume that a standard waiting period applies to every DUI or that its end guarantees physical release.

What still has to happen at the jail?

Confirm that booking and identity checks are complete, the authorized bond has been accepted and no other warrant or hold remains. Ask about safe pickup instructions and the present release stage. The court hearing, acceptance of money or a surety instrument, and physically leaving the facility are separate events. Do not plan around a fixed release estimate. The jail must confirm the current release stage and any remaining requirement for this person.

Check the license notice immediately

Georgia DDS rule 375-1-1-.06 says an administrative license suspension appeal under 40-5-67.1 is timely if received or postmarked within 30 calendar days of the issuance or serve date of the notice of intent to suspend, Form 1205 or 1205 S. Read that date on the actual notice; do not count from release or a later criminal court date. The rule specifies a $150 nonrefundable filing fee. DDS currently lists Online Services, mail and Customer Service Centers as submission routes and requires a complete request. Its form calls for a copy of 1205/1205 S. Discuss appeal and any eligible permit option promptly with counsel. Keep submission and payment proof.

A misdemeanor DUI case may be in Fulton State Court or a municipal court. A felony DUI case belongs to Superior Court; use the felony records route below. Use the citation, release documents and assigned case number. For Fulton State Court, begin with its official records route or criminal clerk at 404-613-5085. For Atlanta Municipal Court, use the city’s official Find My Case route. Do not assume that an Atlanta mailing address means a Fulton County case. A missing payment option is not permission to skip court, and bond payment is not payment of a traffic fine.
